• These are the terms and conditions of Adam Mathieson.
• These terms relate to when you engage Adam Mathieson to perform a live performance.
Performance Times:
• Performance times must be agreed to between Adam Mathieson and the client in advance.
• Adam Mathieson has no responsibility for performing beyond the agreed times due to factors outside of Adam Mathieson's control, including event scheduling errors.
Payment Terms:
• A deposit is required in order to secure your date with Adam Mathieson (all payments are non-refundable and non-transferrable). The client agrees that full settlement will be received at least 14 days prior to the event.
The cancellation procedure is as follows:
• More than 1 year prior to event - no further payments beyond those received
• Between 6 months and 1 year prior to the event - 25% of the remaining balance
• Between 2 months and 6 months prior to event - 50% of remaining balance
• Within 2 months of the event - 100% of the remaining balance
Cancellation Terms:
• Should your event be cancelled or rescheduled due to illness, accidents, pandemics, acts of God, or any other legitimate conditions beyond Adam Mathieson's control, full payment will still be required as per the Payment Terms above. It is the client's responsibility to have appropriate insurance planning in place. Adam Mathieson can accept no financial losses where they are not responsible for any such scenarios.
• Any cancellation by the client must be given in writing by emailing Adam Mathieson at adammathieson_@outlook.com. If cancellation occurs, the client accepts responsibility of cancellation of fees as detailed above.
Changes to original brief:
• Once entered into an agreement via payment of a deposit to Adam Mathieson, the client may not change the brief. For instance, if Adam Mathieson has been booked to perform a ‘Solo Package’ at a wedding ceremony, the client may not change the brief and request Adam to perform with another singer or performer.
In such cases;
(a) the client must retract the request and the original brief shall be followed
(b) if the client insists on the change, Adam Mathieson will retain any payment(s) and cancel the booking
Outdoor Performances:
• The weather must be dry, with not rain present at time of set-up and no rain forecast for performance times
Working Conditions:
• The client is required to provide Adam Mathieson with safe and appropriate working conditions, including a minimum of a 1.5 metre by 1.5 metre are for setup and performance. Adam Mathieson will also require access to a reliable power source.
Illness or Accident of the Performer:
• In the event of illness, accident or injury, resulting in Adam Mathieson being unable to fulfil the engagement, Adam Mathieson will attempt to secure a replacement that is equally skilled, competent and able to carry out the performance to the client's brief. Should this prove to be impossible, Adam Mathieson will full refund any and all payments made by the client to Adam Mathieson in relation to the performance(s). The client agrees that Adam Mathieson's liability shall be limited to the amount equal to the total booking value and that Adam Mathieson shall not be liable for any indirect or consequential damages arising from any breach of contract.
Attire:
• Adam Mathieson's attire is to be smart and presentable and in accordance with what has been pre-agreed with the client. Adam Mathieson will conduct himself in a correct and proper manner whilst present at the venue.
